These Terms and Conditions ("Terms") govern your access to and use of the ArmorSend platform (the "Service"), operated by ArmorSend ("we," "us," or "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service. We may update these Terms from time to time, and your continued use constitutes acceptance of any changes.

Description of Service

ArmorSend is a privacy-focused secure file sharing platform. All encryption and decryption occur client-side in your browser using the Web Crypto API with AES-256-GCM encryption and PBKDF2 key derivation. Files are stored temporarily on our servers in encrypted form and are automatically deleted after all recipients download them or upon expiration (24-72 hours). We do not access, store, or log unencrypted files, passphrases, or personal data beyond what is necessary for the transfer.

User Responsibilities

You are responsible for:

  • Generating and securely sharing passphrases out-of-band (e.g., via phone or encrypted chat).
  • Ensuring files comply with applicable laws and do not infringe on third-party rights.
  • Not using the Service for illegal activities, including but not limited to transmitting malware or violating intellectual property laws.
  • Maintaining the security of your devices and passphrases. We are not responsible for any loss resulting from compromised passphrases or devices.

Intellectual Property

The Service, including its software, design, and trademarks, is owned by ArmorSend and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service for its intended purpose. You retain ownership of your uploaded files but grant us a limited license to store and transmit them in encrypted form as necessary to provide the Service.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure from unauthorized access.

Limitations of Liability

To the fullest extent permitted by law, ArmorSend shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to loss of data, profits, or business opportunities. Our total liability shall not exceed the amount paid by you for the Service in the preceding 12 months.

We are not liable for any damages resulting from hacks, security breaches, or unauthorized access to our systems, despite our implementation of reasonable security measures such as client-side encryption and automatic file deletion.

Indemnification

You agree to indemnify, defend, and hold harmless ArmorSend, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service in violation of these Terms.
  • Your violation of any third-party rights, including intellectual property rights.
  • Any content you upload or share via the Service.
  • Any failure to securely share passphrases or protect your data.

Force Majeure

ArmorSend shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials ("Force Majeure Events").

Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of laws principles. Any disputes arising from these Terms shall be resolved through binding arbitration in Lake Mary, FL, or in a court of competent jurisdiction if arbitration is not enforceable.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after such changes constitutes acceptance.
